I wanted to start this thread for those of us who filed for I-140 with an LC subsitution.

Please provide the details of

Hi Guys,

Pleased to see my EAD approved... but I 140 is still pending. Here are the details:

I485/I140/EAD - Concurrent
VSC, EB2 (Masters)
RD: 11/01/02
ND: 11/26/02
FP: 01/25/03 (Scheduled)
EAD: 01/07/03

Keeping my fingers crossed for I 140 approval..!![
 
Temporary I-485/N-400 Freeze Finally Lifted

indicates that "In the interim, cases were reviewed but no final approvals were issued, creating a backlog in the system that is being addressed only now."

I was wondering if anybody knows which "cases" is the above line addressing?

I have seen several cases which have been approved during the "freeze" time.

I called INS VSC today and talked with IIO in regard to my EAD application (Aug28, 2002); it has been 5 months now and I have not heard about my EAD application yet. The INS VSC processing time indicates that it is in "Current" state for EAD application. He said check back in 60 days.

Well when I called them twice in past two months for my EAD each time they used to say call in 30 days. Now they have increased the time from 30 days to 60 days.

Is there anybody in the same boat as me. I-140 (EB3 Labor Substitution) application pending for 10 months; EAD pending since 5 months.

I too had I140 LC Substitute case filed in April 10 2002 and it was approved recently on Jan 2nd. However I got my EAD on Oct 10th after filing for it on Sept 19th. So hang in there. Ways of INS are known to noone. Good luck.

PS: You can goto INS office and get an interim EAD if you application is pending for more than 90 days which is true in your case.
