Here is my story:
Company A filed my LC from state of MD in Sept, 03 (EB2). Subsequently I left that company and joined another company B in MD, which filed LC in Jan 04 (EB2). Company C acquired company B and moved me to CT and closed the MD facility. Company C filed LC for me in Oct 05 in PERM in EB3 (my new boss turned out to be a manupulative $#%@?). Received 45 day letter for the LC that was filed in company "B", mid of 05, had to tell them to close the case, as the facility was closed and this could not be used for me. However, the company "A", which filed for my LC even before company B, in the same state says it has not yet received a 45 day letter for my case.
Now, poor me, I am in a situation that the screwey company "C", which finally did file my LC in sept 05 (EB3), job is not looking very stable and I fear that I might get laid off, so I recently talked to company "A". However in the meanwhile since, the company C process was filed under PERM, the LC was approved and I-140 has been filed (Jan). I am hoping that it will come through before I get laid off.
Company "A", I am slightly apprehensive of this company. The employer said that he will be very happy to employ me again, however he has not heard anything about my LC for more than 2.5 yrs now. There is another guy in the company who filed for LC around the same time as me, he also has not heard anything. So I know that that's true. I however can't imagine that no 45 day letter has been received for my LC which was filed in sept 03.
Meanwhile I am in the 6th year of my H1B visa.
If someone can help me with the following questions, I would greately appreciate their help:
1. I need to find other guys who filed their LC around Aug/Sept 03 from state of MD to verify whether they received their 45 day letter.
2. Is there a way for me to find out where my LC is. What I mean is that suppose my 45 day letter was not answered and my case was closed, is there a way to find that out?
3. With Company "A", I have Sept 03 priority date in EB2 category, while my current company "C", it is Sept 05 in EB3, so probably with company C, I can hope to get my GC before my 40th b'day. I am contemplating changing jobs to company "A". Will my I-140, from company "C" be a total waste, if I do go back to company "A"? What advice do you guys have.
