LC still pending

I have applied for my LC in texas. My papers are in the regional office dated Feb 18th 2003. Texas DOL has been in Jan 2003 for the last 5 months. It has been more than 2 yrs since my LC has been filed. Now i am at a point where my project is getting over in a few months, and unfortunatly i have to look out for another job. My present company is ready to keep the paperwork going for me. Now my question is that can i change companies at this stage, which my lawey says is alright. I am told that as long as i maintain the salary and job description stated in my LC i should not have any problems. I am not sure about this, please advice me.

I don't know what your attorney meant by saying that you will be OK if you change employer keeping same position/salary.

From immigration point of view, if/when you change employer you need to restart the LC process with new employer/location.

If you change the employer while LC is pending old employer may let process to finish. S/He should be willing to continue the process in your absence. In this scenario, you might get LC approved and you can comeback and start working for petitioner again.

Yes that is what my present company has agreed to do. They have said that they are willing to keep the petition going for the GC even thought i will not be working with them.
Have you heard of any similar cases such as mine? Also i wanted to know what happens if the new job is in a differnt state, will that pose any problems.

I know many such cases. Couple of them already got their GC approved after coming back to employer and continuing the process. Also, few are waiting for LC approval.

New/Old state doesn't matter for new employment if old employer is willing to continue the process.

That is good to hear that many people have done this, but this whole thing is still a bit confusing and i dont want to take the wrong move and lose all this process. Is it possible for you to put me in touch with any one such case you know of. That will be very helpful. I have a lot of questions, my lawery has answered a lot of questions but it is always better to find out more and it is even better to speak/ask someone who is in the same boat as me.

The main thing i need to know is what was the criteria for them when they were looking out for the new job or changed jobs? Salary, job description????? etc

No problems

As long as your employer is agreeing to continue the labor thing...you are ok. GC is still for future job only....Lawyers can handle the situation make sure you have a great lawyer. Also make sure ....not scaring you but just be on the look out....see to it that your old employer does not sell you labor and substitute it for somebody else.

... You need to make sure that job title/description is same and new company is willing/able to continue the GC process.
