I would like your suggestions to the situation that i am in.
I have a Non-RIR EB3 (BS + 3 yr exp is the basic requirement) with PD Feb 2003 LC pending with PBEC . I am in my 8th year h1b extension and will soon file for my 9th yr extension. I am getting promoted to a position that has a basic requirement of BS + 4 yrs exp. This also means that my 9th yr h1b extension will be for a new position.

Can i keep my existing LC going eventhough requirements for the new position is different but still is in EB3 category?

All suggestions, new options and comments are appreciated.

I think so...the whole GC process is based on the job categories and each job category is broad enough to allow increase in responsibility (and sometimes, change in job duties as well).

I've personally changed three jobs during the LC process (each in a different function and of increasing responsibility), however, my lawyers have claimed that all these positions are 'similar enough' from skill set that LC application does not need to change.

So, find out what job code your LC was filed under and read the job description from DOL website...till your new responsibilities are 'similar enough', you should be fine...

PS: My 2-cents, never compromise the career for GC...a promotion is worth much more than GC in the long run...good luck! :)
