LC remanded to SESA

Hi... I work for big (10,000 emp) company and recently heard from my lawyer that my LC application has been remanded to SESA to go thru traditional labor processing.

My LC application was filed in sep 2001. I know that since my company has laid-off recently, and since due to the bad economy there is a chance that my LC application getting rejected when it goes thru traditional processing.

So what are the options that I have?
Should I withdraw my application or can my company lawyer do something at this point. Is there anything else that I can do at this point. I do have around 3 yrs on my H1.

Remanded to State

Aprm, presuming that you are in CA Iam giving some info which might help you.

Lately for Receipt Date at DOL greater than July 2002 there as been a lot of Remand to State. Looks like almost every single IT case has been Remanded to State. This means you go to the NON RIR queue preserving your priority date. Which means you need to wait a long time to get your turn on the ever stagnant CA SESA NON RIR Queue.

Solutions I heard of are to apply labor through different State if your company has branches and is willing to do that. Usually this is very much a big deal for the employer. PERM might also help it but there are lot of disadvantages with PERM.

Hello!

In light of what is happening to RIR's being remanded back to SESA, can I assume that this is because the advertisments were done before the fall of the "dot com" area and that as there is a lot of IT people available presently? The reason that I asked is that the advertisments for my case is being run now, so the "testing of the labor market" is under the present conditions. Would I have a better chance of not getting remanded. I am in CA. Please advice.

Who knows what DOL will decide when your papers reach them. In general, in CA, it looks like thay don't really care and most of applications in High-Tech (not just IT) are being remanded to SESA-s.
