Hi,

Can anyone please confirm:

My attorney has recently applied my LC in Delaware. The letter (recruitment efforts etc.,) my employer provided to the attorney had a length of 8 pages long.Out of those 8 pages, 2 pages had company's another brach office address.Company name, logo are same but the address was of different branch location/state.

Can anyone please tell me is this acceptable to SESA and DOL?

Thanks

be cautious

indgc123:

Don't you think it will create confusion if you have 2 different addresses ?SESA looks for minute details. If I were you,I would definitely rectify this problem by submitting documents which bears address of my work site only and not from other sites even if it is from my company.

The only possibility:-They might overlook it but than you are at somebody elses mercy.

Thanks for your reply.

My question again is will this oversight lead to LC denial at SESA or DOL?

If SESA/DOL send any kind of query then my employer is ready to provide another letter on the right letterhead.

Thanks

If you will be working at your company's branch office in another state when you get a g.c., then I don't think Delaware SESA will accept your L.C. You have to do it in that state instead.

There are only two (at most) valid locations to file an LC:

1. The work location
2. The corporate headquarters (for roving employees).

Hi Jim,

Please advice.Here is my situation...

Actually,my company's corporate headquarter is in New Jersey and my work location mentioned in my LC is Delaware branch office.

As a matter of fact, out of those 8 pages,2 pages were printed on headquarter letterhead i.e NJ office. The content on these pages were about Employer's profile, rest of the essential matters like recruitment efforts etc., was taken printout on Delaware office letterhead.

All the recruitment result details,Employer signature are on Delaware office letterhead.

Thanks

I wouldn't worry about it (Although I would discuss it with your attorney). Everything seems legitimate. If DOL has any questions they will issue and RFE and then you can explain the situation in detail.

Hi Jim,

Thanks again for your reply.

I spoke to my attorney regarding this matter. She said, that's Ok don't even bother about it.

I have to wait and see how they react.

thanks
Indgc.
