I ( company Attorney) have filed LC in NY in Feb 2002 (RIR). As i hear , Apr'01 is not going to move till end of this year and then my turn will come probably in 2004 ( or earlier, does anybody think ?). My H1 6 years is upto Oct 2005. Can anyone advise and help me take decision, do i need to worry enough and apply for Canada green card as an alternative ? Has anyone had experience in similar cases regarding LC. Given the new law of filing I-485 and I-140 simultaneaously, does that help in my situation , so I can postpone to apply for Canada ? I want to apply for canada only as last resort, after loosing all hopes and also dont want in a situation where i have to go back to home country for some time as i have growing kids. Thanks all and your reply i will highly appreciate.

Check it out with people who have landed in Canada - sometimes they have been asked to withdraw GC processing and get H1b cancelled at port of entry. US and Canada share info on immigrants.

Same goes to state like MD/NJ and many others.

Akhand,

:( this suxxxx but not only NY but many othere state people too suffering, just bcoz of 245i and may be some unofficial slow process by INS.

You can go for Canada, just for the sake of some relief, but they too made it too tough to qualify (let me know if you want to know more details) and now it will take atleast 24 months to get it.

About asking withdrawal of GC or H-1B, thats not true, I confirmed it thru my friends, one of them running his GC (future employment) and living in canada, and one of them still have valid H-1B thru a american co., and he keep working on both of the place.

Hi RahulatDC,

Please post the details of canadian immigration. Thanks for correcting me - I had this info from a fellow worker.

Definitely Canadian option seems lucarative. If you have links - please pass it on.

You can find out more in...

immigrationportal.com>other country>move in or out Canada. There are lots of discussion there regarding processing time, qualifications, etc. Lots of knowledgable people too.

I also have LC sitting duck in NY SWA (SESA) since Aug. 2001 and according to my attorney "Don't even think about that LC before Jan/Feb. 2003".

Check with your employer if they have office in other state/region where LC comparatively faster.
