LC Dilemma: NEED HELP FROM THE GURU\'S HERE

Is it advisable to file LC in the current economic sitaution. I graduated from college in Jun with a BA in Comp Sci and am just getting my H1 approved quite soon. My company has got a Hiring Freeze temporarily and has laid off 1% of its workforce but not in IT Department (which is where I work). I was told that I can file under EB3 as a Professional with a US Bachelors Degree. But Could the experts tell me whether I would have a good case considering the current market situation or shall I wait for some time before filing for LC. I am in good standing with my company and they will agree to start my Green Card process if I ask.
Experts Please offer your advice in this regard. THANKS !!!!!
 
file when you can

It is better if you file when you have the oppertunity.The issue of Labor in bad times ...is over RIR and Non RIR.So you can apply in EB3 non RIR to avoid complications.
However dont take my word for it ...consult a good Lawyer.
 
There seems to be a lot of confusion here about RIR vs Non-RIR

In a Non-RIR LC, DOL (SESA actually) supervises recruitment. Resumes are sent to SESA and then forwarded to the employer who must interview and hire qualified candidates. The position is still advertised in the papers and qualified applicants pose just as large a problem with Non-RIR as with RIR.

But...

In reality, RIR cases recruitment handled by the company and it can be manipulated easily. But for Non-RIR cases, recruitment largely supervised by the SESA which is not possible for manipulation. I know some of RIR cases where the candidate request some of non-immigrant or otherwise non-qulaified friends to apply their own advertisement for easy rejection. And you can easily figure out what happend to the really qualified, immigrant candidates resumes. Any comments?
