LC based EB2 and NIW----Help

I have pending I-140 based on labor certification/EB2 for the last one month. I-485 concurently filed and biometrics completed. My question is:
:confused: Is this wise to file another I-140 based on NIW being on the safe side?

Details:
PhD Health professional, Postdoc for 3 years, 32 papers, 4 professional memberships, 3 competetive awards, 3 fellwoship awards, 27 conferece proceeding papers/abstracts, reviewer on two scientific journals., Already victim of EB1 denial. :mad:

I saw some of your previous post regarding J1-waiver in Nov 2006. Did you submitted your Waiver with your EB-1 petition ? Why they denied as your credential looks good for EB-1 as well as NIW !! .. Can you please post little more about your credentials like how many 1st author papers? what are the memberships? what are the awards? how many paper you reviewed? and little more on you denial letter? This will help all of us to understand the current situation and hope some one could able to help you !! anyway good luck !

Hi Pana:
I had 28 publications (17 as 1st author) when my EB1 was denied. I had two doctorates, MS, had international postgraduate training courses, one year Postdoc, a dozen nice letters from good world known scientists/faculty from 3 different countries but was denied.
My postings on J1 have no relation with EB1. J1 has never been an issue until recently my new attorney felt that he can sequeeze some money out of me. After many years of going through immigration cases, appeal processes etc, I feel this is our responsibility to keep two professions running, immigration and immigration attornies. I had established record as midlevel university faculty with ten graduate students when my case was denied. You will enjoy this.
My EB1 attorney thought, I was his best case. He is a very sensitive man. After my EB1 denial he quit profession and you know what he is doing :confused:

Regarding denial reason: I dont qualify. :D
My personal feeling is that I wasted most productive years of my life in immigration and still no where.
