LC approved, have some I140 questions

My LC was approved last week and we are now preparing to file the I140 at TSC

Are I140 approvals more difficult than the LC, or is it a formality at this stage? My employer is financially stable with 60 employees. Most RFE's seem to be on ability of employer to pay or education equivalent. Are there any other potential items to be concerned about?

We are going to file as EB2 (BS + 5 yrs)using some experience (1yr) gained with current employer prior to filing for LC. Could this be denied and can I then refile as EB3? We do not intend to file concurrently in case EB2 is denied
