LC / 140 salary VS base salary.

Hello. My LC lists prevailing wage is $$K. The wage on my I-140 is 95% of LC. My I140 has been approved. Since my annual salary is less than what listed in the I-140, my company does not file 485 for me. I filed I-485 by myself with an employee verification letter without showing my currently salary. Now I got EAD already. My question,:
1. when the time TSC processing my case, if my salary still less than what listed in I-140, will it be a problems?
2. One I used EAD, will I lost H1B automatically?
3. If I used AP, will I lost H1B automatically?
4. Which wage is more important, LC or 140?

Ans1: What is % difference btw ur current and LC (not140)? write actual amount pls

Yes. once EAD used nomore H1B

Importance For whom? would u like to share why is difference ur LC and 140 salary?


Are u working with same employer? and on same Job described in LC? with same duties?

What was written in ur EVL?

Was that EVL or ur Job offer letter or appointment letter?

Is that ur concern salary in LC/140 is not matched with ur current W2? if there is difference please write how much difference in actual amount

EAD <->H1/H4

Just learned from my lawyer that you can still renew H1/H4 after you used AP and/or EAD as long as you don't use EAD for any companies other than the one from which you applied I485.
 
My currently salary about $5000 lower than LC. I am working in the same company with same position. The EVL is general descriptor about a programmer. I may post it later.
The reason salary on I-140 less than LC, the company attorney did this and as long as I know, if your wage are less than 5% lower than LC is OK. But I am more that. So someone suggests to change employer if possible even with the same pay.

Importance For whom? When TSC picks up my case, they will focus on my LC or 140’s salary.

a few $k less should not make ur case worst..... so keep ur hope high... and sleep well.... stop worring....

One good thing is u are working with "same employer" + same job + same duties.......... thats very good... very good..........

have some $k less can make differnce but not much...... they won't have any objection....... and even they do..... you have good chances to satisfy......... i.e. "Ecnomic condition. job martket.... company profit lost.. blah blah." you would be fine and it would be okay......

Here is somthing u guesss urself

upto 10% you would be fine.... the $ u mention check urself

if u have
30k: 10% = 3k
40k: 10% = 4k
50k: 10% = 5k
60k: 10% = 6k


most programmers are btw 40k-80k .... unlesss u would be very lucky.....

anyway....... Try if ur employer fix this thing as closer 1-3k difference with LC. that would be fine it would be very nice....... if not..then I think stick with them don't change employer........ (even u have option AC-21)

Be relax, sleep well,... and pray...leave everything on God.. if it is written in ur luck.... you would get GC ...., so stop worring and start smiling :) ...think in this way... if you are getting somthing (GC) from ur sponser then they also expect somthing from u and save some $)...... so compromise if u can...... and second thing I belive you are not alone here in this boat.......
