Layoff related Queries, on H1

Hi

I had been terminated on Nov 26th, due to my visa consideration
the actual term date has been pushed to mid of Jan 2002.

My question(s),

1. To apply for an H1 Transfer are the recent pay stubs must?
2 How recent is acceptable?
2. Does it make a difference if on the pay stub the word RIF Salary
   is mentioned (RIF Reduction in Force)?
3. I will be getting pay stubs until mid january with RIF Salary,
   my actual term date would be mid january. How much time do I have
   before I become out of status.

Laidoff query

I had been terminated on Nov 19th, i am out of status after few days.
But my previous employer stamping is still valid on passport till next year.He did not cancel my H1 status yet.I am going india next week so it will problem for to come back with previous stamping.

i got laid off dec 7th.. but company said they can split the severance pay starting jan 1st thru feb end.

does that mean i am in status till feb end?

if i file for transfer after feb end, can i still be sure of a transfer?

H1 Transfer after Layoff

I have heard anecdotally from several sources including several first hand experiences from friends that most service centers (definitely CSC and NSC) are relatively easy on H1 Transfer.

1. Paystubs are not necessary. However, they are generally added to make your petition a more convincing case and to avoid the possible RFE.

2. INS has been ok with paystubs 1-3 months old.

3. This info is post Sept 11 - i.e approvals after Sept 11..

Yes, you are out of status.

The stamping is valid if you are in status. Technically, INS may stop you entering. However, since INS has not been informed, you can take a chance if you really must go.

Take all docs including your recent paystubs..

Check with a lawyer and Check the news sites/immigration group postings.
 
You can be reasonble sure

See my other postings in this thread. INS has been lenient and understanding from anecdotal information.

As long as you have the paystubs, your chances are very high.
Just make sure that INS has not been informed about the change in employment.
