Lawyer hasn't responded my I485 RFE yet !

Am I the only one who struggle with "my" immigration attorney ?
USCIS e-mailed him a I-485 RFE on June 28th. It is now August 28th and this guy hasn't replied to the I-485 RFE yet !

There is a huge political connection behind him and the CEO of the company I work for and that's the reason I haven't replaced this guy, in spite all attorney fees for GC filing came from my own pocket. This is another example of incovenience during the greencard process and the reason why I recommend newcomers to refrain from immigrating to the US.

As usual, I send him inquiries about the RFE and the jerk doesn't respond.

How long can the attorney wait to submit the reply to USCIS ? Is it 90 days ?
 
i can understand your frustration........my univ people acted the same.....as though it is Business as usual.........they took almost 8 months after i had furnished all documents to send my I-140..........bastards almost feel like ripping them apart...

Sorry to hear of your problems. This process is hard enough with good lawyers. Anyway it is IMPERATIVE that you get your lawyer to respond to the RFE within 90 days. If the response is not received within 90 days, the USCIS will consider the case abandoned. Do not waste anytime.

Dude RFEs have to answered within 90days if not case is considered ABONDONED by applicant by USCIS. Get on their neck now....

I will wait until Thursday and then go in person to his office if I don't hear from him.

Sometimes I think all this came as a curse;my personality is the type that doesn't tolerate being held like a hostage, at mercy of jerk employers and attorneys. Yet I found myself involved in this damn greencard waiting game.
 
similar experience

I had similar experience with my lawyer. After I looked back the time and money wasted in the past 5 years, I suggest you to find a new lawyer. This is my serious advice. Good Luck.

Are you stuck with this particular attorney for the entire process or can you kick him to the curb?
 
Once this entire nightmare is over, one way or the other, I may end up writing a book. It is a long story. CEO of the company and attorney were best friends back in the high school time and continue the friendship from 30 years ago. Honestly, if I were to switch attorneys before, I think all the process with company wouldn't go through. My perception is that CEO wouldn't trust other attorneys in this process if I had replaced her best friend. I know a fellow co-worker who attempted to switch lawyers and misteriously he got terminated. I have been through lots of incoveniences on this. I think there are lots of work environments worse than this, but one needs to have freedom to move on. Otherwise you are too vulnerable.

Now I've reached the I-485 RFE stage, my PD is April 2002. Therefore I don't think it makes sense change attorneys now. I will wait until October to see if those insane dates advance. If not, instead of changing attorney perhaps ir makes more sense trigger AC21 and say goodbye to all of them, altogether. This situation is simply insane.

I've heard stories of people being at the mercy of their employers :mad: Thankfully , I am not in such a situation. My employer gave me all what I needed as far as tax returns and ability to pay ..... I sat down and filled every form on my own and she signed them without hesitation. (I've given her 15 years of my life :p ) I've gotten this far without an attorney and hopefully will get through the entire process without one, Knock on wood :D

I had got an RFE on 485 .. and it came to my home address. I guess U must have filled G-28( :confused: ) along with UR 485 .. This U should not have done .. and Ur 485 RFE would have come to UR home address.

Well do U know the content of the RFE ... Some RFE are usually simple and they would need information from U and not from UR employer.. You can reply to the RFE Urself ... U need to include the original RFE with UR reply.

this is what happened with me .. I got the RFE .. I send it over to my attorney .. My attorney emailed back the reply .. I printed it out and sent to USCIS...

In my opinion .. if the attorney is still not co-operating then U might do the following

1> Go to him and get the RFE document .. if he won't give .. Call the USCIS and say that he is not Ur attoney and the RFE should be sent to UR address.
[Actually the attorney cannot keep the RFE on 485 as secret ... he has to share it with U]

2> Prepare a reply .. U can get help from other attorneys for a little $$$$..

3> If it is EVL then there is a standard format .. and Ur employer has to sign

4> Do it fast, if U do not reply, then they would assume that UR case has been abandoned.

He forwarded the copy of RFE's back in June. I would need to have employer signing the letter requested below. Anyone has a format for such I-485 EVL letter ? If not, I will have to wait until Thursday and hire an attorney to do this for me. USCIS must receive the reply by September 19th !

"You must submit a currently dated letter from your
intended permanent employer, describing your
present job duties and position in the organization,
your proffered position (if different from your
current one), the date you began employment
and the offered salary or wage.
This letter should bein the original and signed
by an executive or officer of the organiZation..."
The letter must also indicate whether the terms
and conditions of your employment-based
visa petition (or labor certification) continue
to exist."

Please clarify this; in my reply to USCIS do I need to include the original I-485 RFE, or it can just be a copy of it ? I have a copy of it which the attorney scanned and e-mailed me. I need to know if I can print this out and send it to USCIS enclosed with my supporting docs.
