Hopefully my story will help the people that have a long delay for the INS to delay their cases
I have request my file VIA FOIA/PA fro NY USCIS , I made this request 5 month ago
During this time I tried to contact them several time , the last answer I got “you file is floating in the build and we do not know the time frame , when we are going to send it to you”
By law, they have to responded within 20 days
So I draft a complain letter, and went to the US district court and I paid 250$ and filed
Filed a lawsuit, I sent a copy of the complain to the officer that is responsible
Within one week, I got a response that they are sending my file
For the people that have a long delay, you can file for a mandamus and get an answer within 1 week, hope this will help

Thanks very much for this information.... Mandamus suit is something that most in this forum are aware of ...

The thing is for fear of reprisal everbody is tight lipped !!!! I had put this option out some time back....nobody responded...

But nice to know that someone from our midst had the guts to file this .... Cheers and all the best to you. Hope you get your approval very soon...
