late filing of federal tax - effect on citizenship application

I have an odd issue.
I filed my tax return for 2005 with HR Block on April 12, 2005. The tax consultant told me my return would be efiled and I received an email saying that my return has been processed. It was only on April 21st I realized that HR Block consultant had a personal emergency and left me and some others in the lurch - that is he just left our returns not filed. HR Block told me that the word "processed" meant that it has my completed return. Later HR Block filed my return, I had to pay a small penalty and then HR Block refunded the fees and also the penalty thus acknowledging its mistake.

My question is, will I be in trouble when I apply for US citizenship next month? Should I go through an attorney?

Late filing of tax returns is NOT a problem at all. People file late returns or ameded ones all the times even after many years later. However, there is a difference between filing a income tax return and paying the owed taxes. What you (and others) need to know is that so long you will be up to date in filing your REQURIED income tax return and paying the OWED taxes with IRS by THE DATE OF YOUR CITIZENSHIP INTERVIEW, you have nothing to worry about it.

Even if you won't be able to file the required tax returns and to pay the owed taxes to IRS by the due date of your citizenshp interview, INS would not deny your application; instead they would still give you a chance after the interview to take care your tax thingy with IRS before your citizenship application could be considered for approval, which is called-contineous of your application which will obviously delay the decision on the application. The maximum time INS is allowed to give to applicants to take care of this matter is 90 days. Afterwards they would deny the pending citizenship application, but you can refile it again at any time without any waiting if you wish to.

One more thing you need to know is that you don't necessarily need to pay the OWED taxes to IRS by the due date of your citizenship application; rather some kind of payment arrangement with IRS regarding owed taxes would be fine.

I've just got rejected twice for the Taxes being filed 1 year late even payed off, three years before interview.
I had problems after 2006 losing my investment in real estate, I went totally broke. Worse times of my life. Anyhow I filed 2006 late and couldn't pay (around $3000). Lost everything after filing. Anyways, got paid off by 2007. Person interviewing got stuck on one thing that I filed late for 1 year and paid late , showing $80 taken out of my tax returns in 2007 (that means I owed taxes). Now, all that was cleared in 2007 and till today 8/4/11 I am paying on time. But no avail. He was portraying me as criminal. I didn't steal, or try to run away. I was trying to be part of American Dream, and tried to take the opportunity but at the end, I lost all my life saving and now couldn't get Citizenship because due to that late pay I show a bad moral character..I passed all English, Civic test twice.
What you say about this now....

I hope you resolved this situation. I am in the exact situation and now having a panic attack. I am filing N400 in April 2013 and filed taxes late for 2008 and 2009 but now filed my taxes and paid in full.
