Last Name Change -- Please advice

Hi Experts,

my wife has her interview this coming week. We had opted to change her last name in the N400. From what I read the last name change is only an administrative oath and does not require a judicial oath in most DO's (Our DO is San Jose).

Can someone please explain what she can expect during the interview. Will the IO administer the administrative oath automatically? Does she need to ask the IO explicitly regarding this? if she happens to get the Oath letter at the end of the interview (I have hears some DO's do that) should that have her changed last name or does the changes last name only reflect in the certificate one obtains after the oath ceremony? Any experience here anyone?

Experts please advice.

If her name change is only to take your last name, a judicial oath is not needed; the marriage-related name change can be handled with a regular administrative oath.

However, she needs to bring the marriage certificate to the interview and tell the interviewer that she is taking your last name. Otherwise if the interviewer doesn't realize that it's a marriage-related name change, they might schedule a judicial oath.

Note that in some locations, ALL oaths are judicial oaths regardless of name change.

But whatever type of oath she has, the naturalization certificate will have the newly requested name. If it doesn't, she needs to ask for a correction.

thanks for your response

thanks Jackolantern...Is this Administrative oath something that the IO will administer then and there after the interview or is this a seprate appointment?

Do you know if San jose DO has these administrative oaths for changes to the last name?
