Last Friday I came to know that my LC got approved from ATL.

Occupation: Programmer Analyst
Edu. Qual: Bachelors + 1 year experience

I joined this company on my schools CPT program and later got H1B after the first year without going for OPT. I got my Masters a year after I joined the company.

Given the above circumstances (I mean the paper 'ad' we placed and my MS details), can't I apply I-140 & there after under EB2 category???


Any help would be appreciated,

To satisfy Eb2 your job should also say that they can fill it only with a person of advanced degree. Since this is your first job ( an assumption, correct me if I am wrong), I am sure you will have tough time explaining to USCIS that the job you are doing requires a masters degree unless you are doing someting very specialized.

Secondly, looks like you got your M.S degree after you applied for the labor so in any case you are not eligible for Eb2 ( the labor says bachelor + 1 year).

Its too much risk applying in EB2 with this labor.

Thanks will_get_there for your prompt reply! That's what my attorney says as well. Based on your reply and my attorney, I feel like it is much safer to apply under EB3 than EB2.

Yes, you are right about my job. This is my first job.

Can you do me a favor by explaning what are all these funny terms on I-140 section mean:
RD, AD, LUD, ND??

As you may have figured I am new to this section.
