Last 3 tax returns or only the last tax return with I-864? Getting 2005 tax returns?

I'm appyling for AOS through my USC wife.

(1) How can we get copies of her 2005 tax return? We always keep a copy of the forms at home. Can we just photocopy these copies and submit? Or do we need to get "fresh" copies from IRS?

(2) The reason I'm asking this is that I contacted several agencies that get the copies of the tax returns for you. These agencies told me that they would not be able to get the tax returns for 2005 (they can only get it for 2001-2004). Please let me know if there is a place from which we can get the copies of 2005 tax returns.

(3) I read somewhere that we only need to submit the tax returns for the *last tax year* (i.e. 2005). Is this correct? I am asking this because my wife's income in 2004 tax year was below the poverty line. (She was a student during this tax year.)

(4) Also, her income in 2005 tax year was barely above the poverty line. Would getting a statement from the bank showing that my savings help us?

(1) & (2) You only need to submit photocopies of tax returns.

(3) You'll need to submit tax returns for 3 years.

(4) Nope. You'll need a joint sponsor.

It's fine to send photocopies of the original tax return. I think when we applied for my GC we sent only one copy of tax return for the most current year. But it was more than 3 years ago, so I don't remember for sure...

and download form 4506-T. You can also call the IRS (800)829-1040 and request it.
 
Thank you all very much for helping out. I will talk to a lawyer to make sure that the the memo that IM85U and I read is still valid.

One more quick clarification though: If my wife's 2005 income was *barely* above the limit (it was around $20K), do I need to worry about this? It exceeds the poverty line and her current job pays about $30K. I know I am being picky, sorry...

That's sort of what I thought. Thanks! Hopefully, $20K will be good enough. Also, thanks for the memo. That's exactly what I had read.

You can send the 1040 for 2005. Carry the transcripts with you to the interview.

It may be a couple of months before you can get tax transcripts for 2005 from IRS. http://www.irs.gov/individuals/article/0,,id=110571,00.html

Thats correct. tax returns from 2005 are enough

You should look at the instructions on I-864 to see what you can use as assets to meet or exceed the minimum requirements.
