Language requirement

hi,

Does anyone know what the impact will be if foreign language skills are required in perm filing? I heard that by doing so it will significantly increase the change of getting audited. I even heard that the change can be up to 100% if a foreign language is required for the position.

Where can I find the informaiton regarding this matter?

Thanks a lot.

Job requirements need to be appropriate for the job. If a language requirement has been added to exclude US citizens, it should cause a concern. An audit would be entirely proper.

If this is the case with your employer, you need a new employer. If an employer would try to commit a fraud in the immigration process, he would not hesitate to treat employees improperly.

A language requirement would likely cause an audit requirement. I had read about a situation where a Spanish language requirement was required for a Spanish teacher, and the case still got audited. The other poster is correct -- the requirement would have to be specifically a job-related reason only, not one that is added to decrease the chance of a US worker qualifying for the position.
