Hi. I am planning to do my landing in Oct. or Nov. this year. I want to know if I can go back to China from VA, Canada after I land there, and then go back to USA through VA, Canada with my approval H-1 status and I-94. I am currently a J-1 visa holder but am applying my H-1B in USA. My I-94 shows D/S with a J-1 mark (my J-1 will be expired on 09/30/01). Can I still use this I-94 to go back to USA from Canada after I chang to H-1 status, or I need a new I-94?

Xuejun, since China is not a CommonWealth state you will require a valid visa stamped on your passport (work, visitor or other) to re-enter the United States, you might want to call INS or surf their web-site and find out \'bout special privileges for Chinese citizens with Canadian residency to enter the US from Canada without the requirement of a visa. For work related visa issues post your question on the respective forums for better assistance.

Thank you, Bobby. But I heard that I can go back to USA without a H-1B visa after I landed in Canada, if I have a I-94 and the approved H-1B status in USA. The only thing I must do is to return to USA within 30 days. Is it right? Hope to hear from you.
