Landed immigrant living in USA - When to add baby.

I need help from law Gurus who are helping others who are in need. Before putting my question, I first wanted to thank everyone who is helping novice people like me. -- Thanks a bunch.

I am a landed immigrant, currently residing in USA with my wife and a son. I am here in USA on H1 till my Masters is done (which would happen in next 6 month time frame).

Currently, my wife is pregnant and we are expecting a baby in March time frame. I have following three options and wanted to know possible problems in choosing one of them.

1) Send my wife to Canada and then there is no problem in adding newly born baby. (Problem is that I cannot go to Canada before June July and it does not look feasible, sending wife alone when she is in real need).

2) We stay in USA, give birth to baby here in USA and get US passport and take baby to Canada on US passport and start adding process there.

3) We stay in USA, give birth to baby here, add her to our file and then go to Canada.

Thanks in advance.

First option is the best. This way your baby will be born a Canadian citizen therefore no problems.

The only problem is that does your wife have a health plan in Canada? In Ontario it takes 3 months to get the health coverage. But there are some provinces where you can get the health coverage immediately. Therefore if you choose the first option research where you want to go in Canada.

The problem with second option is that even though your baby will be a US citizen she will not be able to stay in Canada indefinately. You will have to get her visa renewed every 6 months and you may face problems. Secondly your baby will not get health coverage untill she becomes a PR.

As you are already PR of Canada you dont have any file and therefore can not add your baby to it.

Thanks Kenny.

My wife does not have health plan in canada. We landed in ontario, would this mean she can only get health plan in Ontario or she can go anywhere she wants.

Second thing is that you mentioned because I dont have file baby cannot be added. Then if I choose 2nd or third option, what is the process of getting her PR? By any chance would you be knowing how much time does it usually take?

Regards

Your wife can get the health coverage from any province where she establishes her residenc. Every province in Canada has its own health coverage and has different requirements to qualify for the health insurance.

For example in Ontario the health coverage (OHIP) normally becomes effective three months after the date you establish residency in Ontario. Therefore if your wife goes to Ontario she will not get OHIP for the first 3 months.

I believe that there are a few provinces where you can get the health coverage immediately but you will have to search the internet for that.
