I will be laid off next month after passing 180 days. That's the good news but bad news is market is really bad. I have following questions:

1) Can I wark anywhere /any job using EAD if I can't find a job in my field?

2) Can I do independent contrat job without a sponser company??

3) If I get RFE or interview what are the things I need for INS approval??

Thanks in advance for your help.

Here are some tips...

1) Ask your current company to hold off on cancelling your H1 or informing the INS. Ask them if they can issue you with a letter sying that a futere employment is possible with the company.

2) Search for a newjobs...I know ..easier said than done..but even if you get an offer for a job that promises to start after 1 month or so it is better.

3) Use EAD to get a contract job in your own field, try ot convert that to a perm job down the road...get a letter that suggests this.

4) Get every scrap of paper that your company has for you...offer letter, employment letter, all your pay stubs, company quarterly reports, your own tax returns, originals of all H1 approval notices, labor/i-140 approvals, 485 receipts, EAD/AP receipts.

5) Check with the company' lawyer on how he is going to act with regards to this layoff ...does he continue to represent you...see if you can afford his fees ..or get a new lawyer...get a new G-28 ( blue form ) signed up and sent to the INS to let them know about the changed representation.

my 2 cents
hope that helps and best of luck

Thank you so much TT TT

I will gather all the documents that you have mentioned.
It's big company so I don't think they will inform about H-1 but as far as my knowledge ,it shouldn't matter because my status is AOS pending. Let me know if you differ.

Both H1/I-140 can be cancelled by company

I know that there are reports on murthy.com that after 180 days the company cannot withdraw I-140 etc..but why take a chance. If you can leave on good terms..ask them not to cancel your H1/I-140/labor for as long as they can hold off.

that way you do not unnecessarily get an rfe !
Check with the company if they can issue you with your severnce over 2-3 months , that way you can have some extra pay stubs as well.
