Laid off while on H1

Hello,

Recently, I was laid off from a software company. I had just received my 2nd H1B. My lawyer applied for a B (Business) visa while I looked for another job. However, I just received a letter that my B visa was denied. I am still interviewing but I have not received any firm offers. I have couple of questions at this time.

1. As my B visa was denied, obviously, I have to leave the country. How many days are allowed before I leave the country?

2. If I were to get a job offer, should the new company apply for a new H1B or is my older H1B transferrable? And will I have to leave the country to get my H1B visa?

You have to apply for a H1 transfer immediately. You are actually out of status, but if you get apply for a new H1 within 30 days of you being laid off, the USCIS usually does not pay much attention. It is 30 days to apply for a H1 transfer, not H1 approval. So act fast.

Otherwise, you will have to apply for a H1 transfer, leave the country and come back when your H1 is approved.
