Laid off in the I-485 stage.

Hi,

I thought I'll explain my situation in a different post rather than replying to someone. Ok so here is my scenario:
* Applied for I-485 (AOS) in Nov 2001.
* Received my EAD in Feb 2002.
* H1 expired in August 2002.
* Finished finger-printing in Sept 2002.
* Still waiting for AOS to be adjudicated.

* Got laid off in Nov 2002 (two weeks back)

Questions: What are my options?
* Since Its been more than 1 year since I applied for
the I-485, I guess the portability rule applies right?
* Will applying for unemployment insurance jeopardise
my I-485 adjudication? I have already done so!
* The lawyers at the company I got laid off from advise
me to get a job ASAP before the AOS is adjudicated
otherwise it may jeopardise my AOS. Is this true???

Would greatly appreciate if these questions can be
answered. Right now I have no idea what rights I
have or I dont have.

is depends on the state. What state are you in?
Share your info what you get. I heard there were some cases that INS considered liniently and approved but we need to get more info.

im in the AOS stage.. > 365 days,, past finger printing...

You should be fine

Hi Few things
1. Why did you claim for unemployment......????? Chances of INS finding out are slim to None but why did you take that chance. The way things are going on these days you never know...

Since you have passed 180 Days you should be fine as long as you can find a job within 90 Days if you receive an RFE from INS... If not you are fine.....
