Laid off - Have B1/B2 visa

Hi all,

Hope everyone is doing good today. I just got laid off, and was on my first H1B. I also still have a B1/B2 visa (uncancelled) in my passport, that is good for 8 more years.

I understand that once fired, the H1-B employee has 10 days to leave the U.S. However, with my B1/B2 still uncancelled in my passport, do I have extra days as a visitor so that I have more time to wrap up my stuff before leaving the country?

The 10 day grace period does not exist when an H1 worker is laid off. When an H1 get laid off (actually just prior to getting laid off), he/she should apply for a change of status to B1 (or F1 if possible) to maintain status.
The stamped B1 visa in your passport does not have any value as far as maintaining your status goes. Visa allows you to enter US, once in US, your status is determined by the I-94 (which in your case is H1)
