Laid off before 180 days.

Folks,
I got laid off before 180 of filing I485. Our company closed the door for everybody. What do you think will be the fate of my I485 approval at this point? Please advise me if you have any similar kind of experience or your interpretation of law.

Sorry to hear about your case.
I would suggest the following.
First priority is to get employed as quickly as possible. If you have an EAD it would be much much more easier. Try to find a job that more or less matches the one specified in your labour.
As your company is shutting down I think there will be minimal risk of them revoking or withdrawing the I-140 / I-485 petitions.
Try to find out however without being too obvious whether that is the case. If they are willing, ask the attorneys to continue handling your case even if it means paying them out of your pocket.
Once you find employment just continue working. Avoid moving / address changes. Just hope that INS does not open your case until you 6 months is done.
I know a case where a guy was laid off 2 weeks after 485 was filed and he got his approval in 14 months later.

Good luck in finding a job soon in the same field. Do you still have a valid H1? If so, you may be fine. I doubt NSC will adjudicate on your case in less than 6 months, so you should be fine as long as you have a job in the same field.

I\'m not sure if you can apply for an EAD through a new job in less than 6 months without alarm bells going off at NSC. Talk to your lawyer as soon as possible.

Thanks a lot friends. I do have my EAD and also have my H1 valid for over a year now. I think, H1 is not valid once you get terminated, Right? Well, I can use my EAD anyways. They terminated everybody and said they will be selling the assests of the company to other interested ones. Seems to be like a bankruptcy but they didn\'t say that, may be because it was a private company. I think they are not notifying to INS. I talked to our attorney and she said it should be OK too. But I am thinking of talking to my employers as well.

Actually, all that is required for applying for an EAD is the I-485 receipt.
You don\'t need a job. You can apply for the EAD yourself.

Folks,
I do have the EAD. Does that make any difference other than finding job easily (may be!)? Since my company completely shutdown, is it different than getting laid off? Can I work as a consultant in same/similar field or should I have a full time job?
Please advise.
