Laid off after 180 days, apply for F2 or not?

Hello everyone,

I have a question. Unfortunately, i got laid off last week. My 485 has an early December 01 RD (VSC). I was working on EAD for my last company.

Now I have two options:

1. Find a "similar" job and use AC 21/180 day rule. However, getting a new job is difficult.

2. Apply for F2 visa and maintain status. This app will take INS about 6+ months to approve. My GC can get approved in four months.

Please advise, if #2 is even advisable.

you are still in status regardless, Your status is "Adjustment applicant" or "adjustee". I think its a better option for you to find a job. You need it anyways...
 
Maybe you cannot apply for F visa, because F visa is non-immigration visa, its basis is that you do not have intention to immigrate to USA, but this conflicts with your green card application.... So, it is better to find a similar job ASAP...

1. I agree with sunny and aou812. #2 is not an option.

2. You need to find a similar job SOON. If you get an RFE for employment and you are not employed at that time, your application WILL BE rejected.

I am in the same boat as you, just try to find a job in similar position.
There more possibilities that your case get approval without RFE, that is the best case.
the worst case you won't able to find a job, and INS request the RFE( pay stub, employment letter etc.) you got 84 days to respond.

do not worry try to get a job.
