I laid off >180 days of my I-485 RD. I am searching for a job now. My understanding is , inform to INS after getting the new job thru AC-21, is it right?? If i got RFE (ex. employment letter) before i got a new job, how it works??
 
You should immidiatly look for a Employer and your job should Title or Skills should be same.

Once you get the new job wait for the first Paystub and talk to a lawyer to send Employer switch letter to INS and use AC21


According to Sheela Murthy Lawyer from Baltimore, now INS HQ has stated that new Employer should pay you the wages according to your old Company LC ( after GC) and it should be stated on New Employer letter

The clear meaning is that now all who want to use AC21 have to get LC from old Company or Company Lawyer then only you will know what Wages were written on your LC by old employer and it will create problems to get LC from Old Company lawyer or old Employer.
If you get RFE before you join new employer, I am Sorry, I do not know how to handle this

And also can i relocate to any where in US for a new job or I have to be in the same address and same place till i got the I-485 approval..

Same situation

I got laid off and got a new Job after a month. I got an RFE before I got the new job.. Just read my case at I485 California center with the tag "URGENT>>>>>GURUS PLEASE HELP"

I was scared to death when I got the RFE. Fortunately I got a nice job and everything works out fine.

I don't know what will happen if you don't have a job within the three months timeframe of RFE. All I know is if you don't respond to it, then you automatically abandoned the I-485 application.

If unfortunately, you can't find a job within three months, I suggest you respond to the RFE anyway with as much as stuff you can fulfill the requirements as possible and then pray to God... If you got rejected, then you can appeal. Probably you can use the appeal time to find a job and resurrect your case.

For some reasons, I never heard of any case that fails to respond to RFE, so I can't really tell you what will really happen...

I filed I-485 at NSC and laid off from job afetr > 180 days. If I moved to California or new york on new job, Is my case transfers to local center or it continues at NSC??

COngrats Yee man. I could not understand your RFE.
Did the RFE explicitly ask for paystubs or was it your interpretation. I mean, usually they ask only for an emp letter and rarely for paystubs.

ANyways, I am waiting for the 180 days too. Yours was a little too fast I think. I hope mine will take at least another 6 months.

Based on the posting I read from various immigration sites, Employment RFEs seldom asks for your employment letter, in most cases, they wants pay stubs, W-2s, proof of good financial health for your sponsoring company.

I think my speed is normal. It took me 15 months total for the I-485. My ex-co-workers who didn't get RFE got approved in 10 months.
 
I understand that the emp rfe for 140 asks for paystubs. I got an RFE and we replied and 140 got approved. At the 485 stage I think the check on company is completed unless ins thinks there is fraud involved. It may ask the employer if he continues to have interest in hiring the employee and hence may ask for a renewed offer letter.

When did you apply 485 and when did you get the rfe.

The case won't be transferred just because you started working elsewhere. INS has to know it. Either you tell them or you respond to an RFE saying you moved.

I don't think using your own company will work in the case of RFE. You need to show that your company has the financial strength to pay you at your LC salary. It seems to me you will need to do quite a lot of things to do that. I would recommend this only as the last resort...
