Labour substitution

Hi,

Filed 140 using labour substitution in VSC. There is a mismatch in the educ. qualification. The LC says B.S. Computer science 3 yrs exp. but I hv 7 yrs exp and my education evaluation says
B.S electrical engg with specialisation in comp engg. Wl there
be any RFE or problems in I-140 approval. If anyone knows abt this pls reply. Wud be helpful.

If the LC says BS in Computer Science without mentioning "or equivalent" you might run into trouble since you do not have BS in Comp Sc. What is the exact wording in the LC?

Bacheolars Degree with Computer Science Engineering
Does not mention any equivalent

My credential evaluation:

B.S in Electrical Engg. with specialisation in Computer Engineering.


Will there still be problems?

You have to meet every single requirement of the job as specified in LC. If you job requires a bachelor's degree in Computer Science and you don't have it, then USCIS may not approve your I-140. Don't assume that your educational background will be considered equivalent to a BS in Computer Science unless it is stated so clearly in the Labor Certification.
Just curious, if your degree is in EE how does the credential evaluation mention Computer Engineering? Have you completed sufficient coursework in Computer Engineering? This question is also likely to come up as an RFE, so be prepared to provide a convincing answer to USCIS.
 
Thank you! My attorney(murthy) told me that the chance of getting I-140 is 70-30%. I don't know i hv to keep my fingers crossed.

I didnt do any computer course but the credential eval came out like that. Anyway i'll be prepared for the RFE.
