Labour substitution and higher salary

I got a labour substiitution from a consulting company. I already have a client and joined this company with my existing client. The labour was for a person and the salary he was offered is much less than the amount of money I am making from my present client. So would this be any issue in my green card processing?

Find prevailing wages for the DOT code as on LC for that particular SESA where it was initially applied. It will answer your question.

Check the approved LC for salary offered for job. If your current salary is equal to or exceeds, you should be fine.

usnycus is right. My answer would apply in case of defending any RFEs on salary.

Yeah if it is higher(how much more that only a professional laywer can tell you best) it should not be problem. I have seen people getting substitution approved with salary as high as 30%.

I think there is no fast rule, but if the new salary is significantly over what was previously approved for (I guess DOL gives some consideration for inflation etc), you might get an RFE, as LC is for "particular position/particular location at a particular pay (with some wiggle room)". They can claim that there might be a PR/USC who will work for the new salary. (Please note: the LC is approved when no PR/USC is qualified or willing to work at the stated salary)
