Hello,
Need a advice on GC Labour rejection

One of my friend got a notice that the GC labour has been rejected. And now the lawyer says that he has to wait for atleast 13 months before he appeals again or wait for another 6 months to reapply for Labour.

Is that true? Can some thing be done about it ? Please advice?

I dont think you need to wait 13 months!!, I believe you can appeal immediately. However waiting for 6 months to reapply is true if applying for the same post.

Could you please "State" where your friend filed. Is it a direct rejection beofre any NOF, RFE etc? Reason, if any? Thanks
 
Before it was rejected for my friend a notice was sent to Prove that his company did not lay off any one in the past 2 years and apparently in the records it was given that the compnay DID lay off just 1 person in the past 2 yrs and on this grounds the Labor was rejected.

Can someone suggest what steps could he take next?

if company can prove that it was not lay off ( performance or something else) it would help... also if company has hired any body in similar profile since lay off.
