Labour Pending for more than 9 months

Hi,
If my labour is pending for more than 10 months and i continue to work for the same company @ india branch after H1 expiration of 6 yrs, then can i come back to US on H1b with 7th yr extension after 2 months working in India branch office. coz, at that time , i would have crossed 365 days of pending labour and can apply for my 7th yr extension.

Please advise what i can do with this situation.

I have few questions on my 7th yr extension.
My labour is filed by Company A which is pending
more than 365 days now.
I am joining Company B now.
In 9 months i would be reaching my 6 yr limit in
USA.
I have few questions.
Can i file my 7th yr extension now thru company
B ?
During the next 9 months, if the pending labour
is granted, Can i still file my 7 th yr extension thru
company B.
During the next 9 months, if the pending labour
is granted and used by company A for some other
consultant with the same skillset, can i still file my
7 th yr extension thru company B ?

I really would appreciate, if you can answer these
questions immediately.
