Labour PD question

Hi All,

As you already know EB3 are retrogressed to Jan 1st, 2002. My labor filed in Sep,2001 and approved in 2002. My employer filed only I-140 and got approved in 2003.

My I-485/AP/EAD filed in Feb,2004 and got EAD,AP

My Question is since my labor PD is current now, Can I expect my I-485 approval soon

I would really appreciate If you get back to me

After Jan, only cases with PD earlier than 2002 will be approved in the EB3 cat. if the country of birth is INDIA, CHINA or Philipines...
How it affects other cases is anybodys guess... However one thing we can say for you right now is "You are off the hook, So your approval will not be held back because of the PD issue.
