labour Clearance in CA

Hi,

MY LC was filed in May -03 & I got letter from Labour Dept which was dated 5/5/03.Now as per the processing times at California center I expect it to be cleared some where around April end - 04

Gurus , pls let me know whether can I assume this time-frame ?
Iam asking cause I have some personal plans based on this

I think your labor is still with state labor.

Depending RIR or non-RIR its going to take more than 2 years for RIR to get your Labor and more than 3 years in case of non-RIR case. so you expect your Labor any where between May 2005 and May 2006.

If its at DOL reduce those time frames by half.

If by some miracle, if the the processing speeds up you may get in next year.

By present times, anything over 2 years can be expected. With INS/DOL, one lesson you need to learn early is that you need to give them time . The sooner you get it, less frustrated you will be.

Hey but as per LC processing times displayed ( State for CA - 11/2002 & Federal - 11/2002 ( Iam into RIR category ) )
Don't you guys think that If my LC was filed in May-03 ,it should get cleared somewhere around May-04 ??

I know , Iam over optimistic here, but seriously Would like to know your thoughts

Hi Sandeep

I think you probably need to do some research here what those dates mean,

CA State 11/2002
This means that this is what they are currently processing.

Federal 11/2002
Once you clear the state then Federal Date means the date the application was moved from State to Federal.


So for example lets say someone had file in 11/2002. Then it means that they are processing this for the state currently for this applicant.
For the sake of simplicity lets say he clears state today then federal receive date on his application will be 11/2003 or more precise( Nov 14 2003). So he/she will need to wait atleast another year before they process his/her application.

I also went thru another 4 months in a stage where it was approved by the state dept and forwarded to the regional center and it took 4 months to enter the regional departments files..thats again lost time

Thanks again for immediate reply.I understand that you guys are pretty thorough with these GC processes.As mentioned my LC filed on 5/5/03.When do you see the light at the end of tunnel ?
I mean tentative for me getting the actual Green card

No point trying to figure out the ways of DOL/INS.My advise? Sit back and enjoy life - if you start counting days to a potential approval date, one of these days, you will register here again with a nick like mine and screw up life for yourself!
