Labour certification

Can somebody let me know that whether it is possible to use someone's labour certification if that person had MCA degree and I am a BE.

Nope.

Labor certification is stricly based on skill set, which includes educational background including training and on the job experience. Candiate's profile has to match exactly to the job requirement, and already approved labor cert. And then it becomes eligible for the labor transfer.

Then "dude" surely becomes eligible for the transfer. Still, it has to go through DoL, and they may deny transfer or ask to refile it in other category based on company hiring-history, job-profile etc.

This is what, normally happens in acquisitions. But (self interest driven) attorneys never recomend this approach.

If "dude" changed the company on his own, then both the compnies have to agree- old one to release labor cert. and the new one to take on to that, and that's a far complicated one. I did hear one such case in good days (2000).
