Labor transfer?

Hello gurus!!!

I'm on H1B visa and I filed for my labor certification (NJ) from company A. Later I left company A and joined company B. If company A gets my labor approval, can I somehow transfer that approval to company B?

Please let me know ASAP.

NO.Because LC is not filed by you(Employee).It is filed by company to hire you.
But if both you and company A come to an understanding that you will work for them upon getting green card ,you may continue the process as you are aware green card process is for future employment.

2- After I-140 approval?
3- After 485 approval?

Change of status? When?

For how long should I need to stay with company A?

u don't need to join company A at all as long as both u and company A have intent in good faith to work for each other after ur application is approved. but all during the process company A should be indicating their intent to hire.

I'm little confused so I just want to confirm again:

I will get a green card that is permanent resident ship in United States 'cause of a company that I never worked for???

I dont need to join the company even after my GC approval???

Again I just need to be 100% sure 'cause this is really a matter GREAT importance to me.

There is no law that forces you to work for them even for a single day. But (there's always but) INS makes an assumption that the company and you have an intent for INDEFINIT relationships. So, overall consensus is to work for company A for at least 6 month. This might get messy when/if you apply for Naturalization.

And yes, Work sponsored GC is always for future employment intent. Company A does not even has to be in the same state (or same country), you can have as many companies sponsoring you as you wish and you can actually be in your home country during the whole process.

like hexamon said u will the get the gc without ever working for company A. this MAY pose a problem only when u apply for citizenship.

safe bet is to work for company A after u get ur gc for 6 months to an yr...
just my opinion...
