Labor Substution ... Pls Help

My 6 years ( H1-B) are coming to end in May 2006. My company allready applied for 7th year extension. My Labor certification is pending in P-BEC ( PD Oct 2003 ).

I have got an offer from a company ( Indian consulting firm ) with labor substitution. How safe is labor substitution?
Is there a problem in 140 stage if I do this. I may or may not have to do little modification to my experience and skills for this. PLS advice!!! Thanks in advance

As far as banning of labor substitution, it is not into effect.For the time being it looks like you are safe.Meanwhile can you inform me under which category your greencard is processing?If it is EB2, it may go fast in forthcoming months.
Do contact some good attorney before taking any decision.

It may be risky at this time. You'd better wait few more days to see what is the new final rule suppose to end the commeting phase in Apr 1st. They may ban sub-lc based I-140 at all.

How is 140 approvals based on substitued labors looking?

If U are getting a labor substitution for free ... grab it .. its a best bet to beat the retrogression...

140 stage is no problem if your qualification matches the labor.. and the employer can tackle the ablity to pay issue..

100's of thousand guys are going for labor substitution instead of waiting in the never ending line..

But U should be carefull ... the employer should withdraw the previous applications ... generally Desi companies do apply for multiple guys on same labor ... and in many cases mutiple guys have had got there 140 or 485 approved too ...

Yes they are planning to ban the whole concept of labor substitution ... so U must hurry ....
