Labor substitutions

Hi Guys,

Can we file I140/485 concurrently with a labor substitution. Whats the risk involved in it. My labor is filed in Chicago. But its taking more time now days. My company has an approved labor and they are recommending to use it, since my 6 yrs h1 time will be up by end of June. I have the same qualiations, salary and Job description ( very close to it) that are mentioned in the approved labor. And also does anyone have sample formats for experience letters. Please advise.

If work exp and educational equivalence is there - then LC subst is no problem. You may like to check financials of company for 140 risks.
 
pre-approved labor

Your advise on this question is highly appreciated.

My company is trying to use a pre-approved labor. The priority date of the labor is 9/1999. Education, experience (1 year) and tech skills match.

I have worked for company A for 1 year in 7/1997 to 7/1998 and then joined company B in 8/1998 where I worked for more than 2 years. I worked in same skills in both jobs which matches labor.

Can my experience in company B alone be used for substitution? The problem is my lawyer is asking to get reference letter with technical skills for company A. I do have experience letter from company A, but tech skills are not mentioned in that. That company is closed and I have lost touch with the collegues.

But I can get refererene letter from company B, where I accrued 1 year and 1 month experience before 9/1999.

My understanding is that I should have 1 year of experience before 9/1999. Is this correct?

Is it suffiecient to document experience only from company B for substituring labor?

Is there any requirement which says I should have 1 year of experience before the date that person (for whom the labor was filed originally) joined my current company?

You cannot use the experience of your current company. You may get experience letters from your co-workers in A.

Thanks for your immediate reply, just want to clarify... I left company B after working there for 2 years. After that I worked for different employers and I am with company x now who is doing my GC.
