Labor substitution

My RIR conversion to PERM (EB2) was rejected a few days ago. I am already on 7th year extn. I need 8th year extn in June 2007. My company is filling for I140 using a pre approved labor in EB3 category.
Is this allowed? What are the risks. Does any body know of any such cases.

Any help is greatly appreciated.

You can file I 140 with LC substitution. i am doing the same . i have 6 years contigous US work experience with BE+MBA

did you try converting RIR to PERM EB3 or PERM EB2 ?
