Labor Substitution - urgent

Hi Gurus,

I am planning to use one of the Pre-Approved LC and also received a fax copy of the LC in which under column 14 it is mentioned as following:

Grade : 10
High : 2
College: Bachelors

(this is based on 10+2 Central Board Pattern)

But, I have the following :

Grade : 10
Hight : 1
College : Bachelors

(this is based on 10+1 which is State Board)

So, my question to you GURUS's is can I use this Substitution LC, dees the Grade and High matters which is not what I have.

Would appriciate if any of you can reply me as I have to take some decision with in 1-2 days .

I Don't think so...

I also used labor substitution and I am awaiting approval. I did not provide any information regarding my grade school and high school years. I only sent my bachelor's degree, its US evaluation and experience letters. Make sure you have the same or similar degree and atleast 4 years in bachelor's college an dyour US evaluation says that your degree is equivalent to a US bachelor's degree.

Thanks for your reply, Would you mind sharing information like when was it filed and was it filed using 10+2 even though you have 10+1 schooling.

Does it matter, to use this LC if it shows as 10+2 and u have 10+1.

Will_get_There ... a question for you:

I see ur profile as "Sub. Labor - EB3, 140 RD - 12/11/03, 485 RD - 01/26/04. There are so many EB3 I-140 cases approved that were filed long after you. Do you know why yours has not been approved/processed ? Did you/ur attorney do anything on this matter ?

TSC is slow...

My 140 is not approved because TSC is slow in approving 140s. VSC is the fastest and also if 140 and 485 are concurrenltly filed, TSC handled them together so I am still waiting like many other folks in TSC. The data there is August '03

My school was not 10+1, it was 10 + 2, however the point I was trying to make was that I never submitted the school marksheets when I used the sub. labor. I did not physically see the labor, my company did the matching for me. What does your lawyer say ?

One suggestion, post this message in VSC 140, the guy named UnitedNations there is quite helpful in such matters.
 
Required Bachelor - 4 yrs ... my bachelor - 3 yrs.

Can anybody give me an idea as to what will happen to a case where:

Sub Labor Requirements - 4 yrs Bachelor.
My Bachelor - 3 yrs.
My Masters - 2 yrs both from India.

I have education evaluation submitted as Bachelors in India is same as bachelors in US ... and Masters in India same as Masters in US.

Do you think this will be a problem ?

If so what shoudl I be doing ? thanks - msd_gc.
