Labor substitution...question

I just came to USA and working for a company A.
I have another friend who works for company B and that company is willing to sell its approved labor to company A(to me)

Will I run into problems if I use this?
Please guide me....

OR should I apply for regular labor...

Newbie...

Thanks

Thought that this would help to capture the approved PD which is Aug 2003

Will check with the attorney and go to the next step

I would say, please apply your own fresh labor.Besides the the lack of visa dates if you are EB3 ( Jan 1998 ), EB2 ( Nov 1999 ) is no where closer to Aug 2003, the INS is scrutinizing a lot during 140.

Thanks

I will double check with my attorney. I will then go to the next step.
If this would work then My PD will be Aug 2003 instead of Nov 2005 a saving of two years. This is really cool. But I think this should not be misused. I thought the labor cannot be sold to another company but can be used for another employee in the same company. I do not know hos INS is allowing this first of all. Thanks to INS.

if the pd is before the cutoff, it is worth, else better to wait

and watch the developments over next few months to see how numbers move

It depends on
1>How reliable company B is?
2>What is pripority date of that approveed labor?
3> GUARANTEE ABOUT THIS APPROVED LABOR NOT USED ALREADY
There are a lot of companies are just making business with these approved labors and applying multiple I140's and I485's on ONE SINGLE APPROVED LABOR ..
BEFORE YOU DECIDE
