Labor Substitution - JIM Mills and others Please help!

Hi Friends,

I am working for a company A and almost 2 years back, one of our ex employee's labor certification got cleared. He got laid off after that.
Our company merged with another company and formed into a new entity. The name is still the same but we have a different tax id.
My question is that can I use that Labor certification and file for 140 if my skills match exactly ?

Yes you can under following conditions

1. Your company agrees to it
2. Your skill set, salary, degree and all other conditions mentioned in his LC matches yours

For eg:- eligibility is BSC and 3 years of experience for that LC and it was filed in Aug 1999, You must have earned your BSC degree and 3 years of experience as of LC filing date ie as of Aug 1999.
