Labor Substitution - I140/Name of Beneficiary

Hi Guys,
My employer filed for me I140/I485/I765/I131 with an already preapproved
labor he had for some other person.I just received the receipt for I140 he filed for me and it still has the name of the orginal person(the person for whom th labor was approved) as the name of the beneficiary and not my name!
Should the I140 receipt have my name as the name of the beneficiary?
Pl let me know Thx

How would it have your name, if it was approved on some one else. Once your 140 gets approved, then your labor approved copy will not have his name and it will be whitened out meaning that the labor has been substituted for you. (Only the labor should have his name and 140 receipt notice should have your name since you are the one who is filing substitution labor)

Hope this clears your doubt.

looks like a blunder...

Either your employer's lawyer by mistake filed 140 in the name of original beneficiary instead of your name or the receipt you received is an old one which was received by your employer when they filed 140 for original beneficiary.

In anycase you are sitting on a problem here and better clear up the matter fast with your employer. You should get a 140 receipt with your name on it.

140 receipt should have your name and a A# alloted to you. My 140 was filed as Labor subst. and it has my name .. I checked just now. Looks like a mistake done by your employer. Did you file concurrent. Then wait for the 485 receipt notice and check to make sure that the A# on 140 is same as 485.

Raman,
I-140 should be in your name since you are the beneficiary. If you read the receipt notice it says on it "if any of the above information is incorrect please contact the national service center at the 1800 number. Your lawyer/employer must call and correct this asap before you get an approval.

Just checked my mail and i have received receipts for I485/I765/I131. all are in my name. On the I140 receipt i do not see any space for A#. There is a Applicant section in all the other receipts for I485/I765/I131 which has the same A#. Could you pl doublecheck? thanks

There is no specific section .. but the A# is given next to where it says BENEFICIARY and below it my name is given ... also if you have a A# on 485, then your employer would have filed a 140 else a 485 receipt will not be issued. It looks like you employer has sent you the wrong notice ...

You are right on the dollar, My friend!! Just confirmed with my employer and he said he has faxed me someone else's I140 receipt. They should hopefully be receiving my
I140 notice in the next day or two since i have already received all the other receipts.

A related question though. The faxed copy of the I140 receipt i have only has the
name of the beneficiary and no A# as discussed above. Can you envisage a situation/scenario where the USCIS would issue a I140 receipt with only the beneficiary name and without the A#?

I dont know of any scenario where a A# would not be there .. maybe for people who file consular a A# is not alloted when 140 is filed. At the filing stage, A# is the number to link all your applications together .. so it is used to link up 485 with EAD and AP etc. Maybe for consular it does not work that way because it really is not required until the GC is issued which will be at the POE .. I am not sure though ...
