Labor Substitution Experience

Hello,

My present company is planning to file for my I140 and 485 based on a approved labor case.
Approved labor case had requirements of Master Degree and 3 years experience - Job Title - Software Engineer.

I had experience of 2.5 years as on the original date when the labor case was originally filed.

Question: Has anyone been thru this process and what was the outcome? What are my chances?

Please share your experiences.

Anyways, can you come up with some experience for 6 months, like being a apprentice after you finished college, or something like that ....... all INS needs is a letters of experience that are verifyable

work on this dude... you are too close.

If you apply with 2.5 years experience, you are sitting on a rejection right there. Don't waste ur. effort.

Also as you said, my company lawyer has also recommended what you are saying. I am trying.
 
yes mine is substitution too

However my experience matched ... supposedly ( I never saw the labor, company matched it)

I filed 140 and 485 and got EAD/AP so that tells I140 was not a total fraud. However anything can happen still.

I filed in Dec'2003 so still waiting for 140.

Keep your hopes high and work out something. The labor queue is very long. Only option there is wait for PERM which should be launched by end of this year.

I filed as a substitute labor in Sep 03. After a RFE about company financials, it was approved in March 2004. My EAD/AP are still pending though. My I485/EAD/AP was filed in Oct 2003.
 
Matching the dates is also important

You also need to match the Dates.

ie If the labor states 3 years with Masters on the date it was filed.


for ex say Feb 2002. Then u should have attained 3 years experience and Masters by that date.

If you are still not sure.. give me ur dates. So i can explain it much better
