Labor Substituion

I have a question.
I have a pending labor at DOL (999.151-032), But I know it will take ages to get it.
However, couple of months ago a co-worker was laid off and the his labor got approved recently(999.151-031). My question is can I use this labor? or will it be an issue because he was laid off.

check the qualifications + experience

you may be able to use the labor. however find out if the skills, experience and education mentioned in the labor that you intend to use are matching to yours. if yes, you could use that labor.
however please do check with an immigration attorney. please do not act solely on my advise. good luck.
