I'm trying to use another guy's approved labor for my case, he already got
her GC through lottery. Howver, this is the reply from my company lawyer:
"The approved labor certification is for a XXX Engineer and requires a
bachelors in engineering and four years experience in the design and
analysis of XXX. You would have to have met those requirements at the time
of filing which was August 28, 2002."
when I filed my LC (Jan, 2006), I do have B.S plus 4 years' experience.
However, the lawyer said I need to have this much experience in Aug. 2002,
in order to do LC substitute, since that's when the old LC (the one i tried
to use) was filed.
Is she correct or it's just bluffing?
If not, where can I find official guidance? Thanks
