Labor Substition and Educational Evaluation

Hi Guys,

My employer is filing for my I-140 using Labor Substitution.

The job requirements stated on form ETA-750A are a bachelors or foreign equivalency in CS/EE/CE or related occupations. They also require 2 years related experience. I have an MBA and a equivalency Bachelors Level equivalency in CIS, plus 4 years field experience. What do you think are my chances of getting this I-140 approved.

I guess my issue is, does the INS consider a BS in CIS related to a BS in CS/EE/CE, and if not, do they have the technical expertise to make that decision?

I got an educational evaluation done from Trustforte in NY which came out to:

BS in CIS (3yr Degree and 1 year college work in US)
MBA in Business Administration (from US so no eval required)

I have a 3 yr bachelor degree from Pak, 1 year university level classes in the US, concentrating in Computer Science and then MBA from an University in the US.

If your LC petition says, masters with Business Adminstration, CS/CE/CI blah,blah... would have been appropriate.

For all others, you are taking chances.

Then my question is that for all of in this boat, does the LC have to explicitily state all the degrees that an employer will accept or the employer can use the keyword "equivalent" and "related", thus stating that they will accept degrees related to what is on form 750-A?

Thus, my question, is CIS related to CS?
 
yes,,

the employer have to mention each and every field, if employers mentions equivalent then you shuld support evaluation paper work.

In your case your degree is not valid as it is not 4 years, but you have cummulative of 5 years. This may work out for universities but not for INS.

My adivce file new LC with requirement of Masters

and in that he has to mention all degrees like master of blah,blah, business administration has to be included and in the related fields column of your LC petition she should have mention all you working titiles. thais woould without pain.

Dont waste time. If you want thrill, then go ahead and file 140.
