Guys,
The advertisement for my RIR said BACHELOR IN COMPUTER SCIENCE or equivalent. I am an MBA with major in IT and has one year of experience prior to joining my company. Now the NJ labor department has asked me to prove how come my degree is equivalent. Can the gurus suggest what should i do. My lawyer screwed it up. Should i go ahead and send my information and will it affect my I140

Help guys plz
 
I think it's the type of the degree rather than Master/Bachelor.

MBA is not MS/BS. If you are an MBA in IT, this to me means - Master in Business Administration in IT related field, not a Software Engineer or such.

I don't know what to say. I think you should find another advocate and get a really good legal advice.
 
You need to get an expert evaluation to see if the evaluator can state that you have the educational equivalent of a bachelors in computer science. The evaluation must ONLY use education unless the LC explicitly stated that experience would be accepted in lieu of education (the "or equivalent" language is NOT good enough). If the evaluator cannot provide this, you probably should just start over (or maybe SESA will permit the case to proceed as a NON-RIR with amended requirements since I assume the advertising is not useful).

I note that normally this type of error does not get caught until the I-140 stage so you are lucky that it got caught here and you did not waste any more time.
