labor qurestion...gurus please help

Hi,

I have a pending NON RIR labor pending with DBEC since 2001. I completed my masters after applying the Labor and my lawyer told me that we can amend the application when we get the RI.

Yesterday, I saw the minutes from AILA-DOL meeting on 09/12/2006 saying that no changes will be allowed to make to application except cosmetic changes. I am thinking cosmetic changes may be (change of address or something else) . So now what are the options I have....my understaning is that we cannot amend anything at I140 stage and bt reflecting the masters it makes my case stronger at i140 stage....

Please help me....I have trying to schedule a conf call with my liar and lets see what he has to say...But in the meantime if somebody can answer this questions....

What is the job requirement? Does it need Maters Degree? Sometimes it is hard to convince that the job requires Masters when other employees in the similar job profile are working with Bachelor degree.

Also you must meet degree requirement before PD Date.

Thanks for answer..but I have more questions

No, The job does not require masters degree...it just requires bachleors...Before this MCA, I have three year degree and three year diploma in computer applications....I wasn't thinking of reflecting my masters...but my lawyer told me that...without masters it will be difficult to have i140 approved.

Do I have any options now or I should just looking at packing my bags..

It seems you are trying to use combination for Bachelor degree equivalent. Does LC say that it is ok to use combination to use degrees.

Yes, its true that in your labor application, it should be saying to allow combination of degrees. You may get a problem at I-140 stage. I am telling you this from my own experience. But, my lawyer was fantastic, she replied to the rfe nicely and got my I-140 approved back in 2004 (from CSC).

sO...what are you saying is that if my labor supports combination of degrees then I can show masters at the I140 stage also...I don;t have any doubt on liar's cabability..the only thing is lot has changed sonce 2004....

Please confirm...if I understood correctly, what are you trying to say

I wasn't talking about your Masters at all since it was done after your PD. USCIS won't consider that at all.

I was talking about your 3 year bachelors and 3 yr diploma. Since your 3 yr bachelors is not equivalent to US bachelor's degree (4 years), your attorney should have gotten education evaluation certificate to proove equivalency to US 4 yr bachelors by combining your 3 yr bachelors and 3 yr diploma. And also, your attorney should have mentioned it in your labor certification 'Bachelors or equivalent/combination of degrees are allowed'.
