Labor only required at State level

Hi guys,
I have been this from different places now, it seems if we file for RIR now then the labor needs to go to only state level. It does not have to go to Federal. is this a rumour or true?.

Also my company is planning to convert my application to RIR. Converting to RIR do we get to maintain the same priority date?. My application was filed in GA last year.

Please let me know your inputs!.

Hi Sammya,

My employer is also telling me the same thing. but I am also not sure about it. please let me know if you have any information.

Thank You

There is no news (web, newspapers)about this, so no credibility.
Perhaps it is about "static level" of LC.

unfortunately, I am not able to find any information from my lawyer too. The reason I was concerned is my h1 expires in June 2006 and my compnay had filed last year through Non RIR. They are saying they will convert it to RIR but I am not sure if my labour will clear by the time my h1 ends.
Any members who have any sort of information, please help

Go thru the above link. Ur employer may be referring to the above. But as of now this is not implemented. As to when and how this will be implemented, u have to probably wait until the PERM is out. May be then they will throw some light on how the backlog reduction will be implemented.
U have until june 2006 till ur H1B expires. Long way to go. U can get H1 extensions after that if ur labor is not cleared by that time, but u need to file before june 2005.

You can get H1 Extensions beyond 6 years on basis of labor your employer has filed last year... Just keep that alive & try to convert in to PERM (Nobody knows when it will be for real)
